Adult guardianship is often misunderstood as a benign protective device for older adults and adults with disabilities. The issues that lead to guardianship can often be addressed through less restrictive alternatives that ensure adults maintain the dignity of independence and autonomy. This session will explain how guardianship works, potential pitfalls, and practical solutions to common problems.

Participants will be able to:

  • Explain the legal framework for adult guardianship.
  • Recognize situations where guardianship may or may not be appropriate.
  • Identify alternatives to adult guardianship.
  • Implement strategies to protect independence and autonomy for older adults and adults with disabilities.

About the Presenter:

Nicole Shannon, J.D., is an attorney who represents older adults and adults with disabilities. Her focus is on guardianship and conservatorship, abuse and neglect, and long-term care. She regularly presents to national audiences, including through the American Bar Association, the U.S. Department of Justice, and national aging and disability policy organizations.
